关于印发《肇庆市就业困难人员认定管理暂行办法》的通知
各县（市、区）人力资源和社会保障局、肇庆高新区劳动保障局：
为进一步落实各项就业创业扶持政策，加大就业创业援助力度，构建促进就业创业长效机制，特制定《肇庆市就业困难人员认定管理暂行办法》，现印发给你们，请认真贯彻执行。

肇庆市就业困难人员认定管理暂行办法
第一条 为进一步落实各项就业扶持政策，加大就业援助力度，构建促进就业长效机制，根据《广东省实施〈中华人民共和国就业促进法〉办法》及《广东省人民政府关于进一步做好新形势下就业创业工作的实施意见》（粤府﹝2015﹞78号）精神，结合我市实际，特制定本市就业困难人员认定管理暂行办法。 第二条 就业困难人员认定管理工作由各县（市、区，含肇庆高新区）人力资源社会保障部门公共就业服务机构组织实施。 在市级办理《就业失业登记证》(或《就业创业证》)的人员由端州区人力资源和社会保障部门公共就业服务机构负责认定。 第三条 肇庆市就业困难人员是指具有本市户籍，在法定劳动年龄内、有劳动能力和就业意愿、处于无业状态、进行了失业登记的人员。包括： （一）具有城镇户籍，女四十周岁以上、男五十周岁以上的； （二）经残疾等级评定机构评定为残疾的； （三）享受城镇最低生活保障待遇的； （四）属于城镇零就业家庭成员的；
（五）属于农村零转移就业贫困家庭成员的；
（六）因被征地而失去全部土地的农民； （七）连续失业一年以上的； （八）全日制高校毕业生失业6个月以上并办理失业登记的（办理失业登记时属应届毕业生）；
（九）退役士兵、刑释解教人员、戒毒康复人员、精神病康复人员、需赡养患重大疾病直系亲属人员 。 第四条 申请就业困难人员认定，应持本人居民身份证、户口簿以及就业失业登记证（或就业创业证）原件和复印件，向户籍所在地的乡镇（街道）人力资源和社会保障服务所提出申请，填写《肇庆市就业困难人员认定申请表》（附件，以下简称“认定表”），并按不同的人员类别提供以下材料的原件和复印件： （一）享受城镇最低生活保障人员：提供民政部门发放的《广东省城乡居（村）民最低生活保障金领取证》、低保存折； （二）残疾人员：提供残联发放的《残疾人证》； （三）城镇零就业家庭人员：提供户籍所在地社区居委会出具的家庭成员均处于无业状态且享受最低生活保障待遇的证明、低保存折； （四）农村零转移就业贫困家庭人员：提供民政部门发放的《广东省城乡居（村）民最低生活保障金领取证》、低保存折及户籍所在地村委会出具的家庭无人在第二、三产业就业的情况证明； （五）被征地农民：提供户籍所在地村委会出具的因被征地而失去全部土地的证明。
（六）全日制高校毕业生：提供毕业证书。
（七）退役士兵、刑释解教人员、戒毒康复人员、精神病康复人员、需赡养患重大疾病直系亲属人员：提供相关证明材料。
第五条 乡镇（街道）人力资源和社会保障事务所在5个工作日内完成对申请人申报材料的初审工作，符合条件的，将申请人情况在所属的村（社区）进行张榜公示，公示3天无异议的，上报县（市、区）、肇庆高新区公共就业服务机构。县（市、区）、肇庆高新区公共就业服务机构应在5个工作日内完成对申请人申报材料的审核工作，在就业失业登记证（或就业创业证）原件“其他记载事项”页面上标注“就业困难人员”。经过审核认定的申报材料返回乡镇（街道）人力资源和社会保障服务所。不符合认定条件的，应当书面告知申请人并说明理由；对审核结果有异议的，申请人可向作出审核的公共就业服务机构同级人民政府人力资源社会保障（劳动保障）部门提出复核申请。 第六条 就业困难人员有下列情形之一的，不再列入认定范围：
(一) 连续失业 1年以上的登记失业人员，年度内没有进行求职登记或无正当理由连续三次以上拒绝公共就业服务机构免费就业推荐的。 （二）入学、服兵役、移居境外的； （三）被判刑收监执行的； （四）不应当认定为就业困难人员的其他情形。 第七条 各级公共就业服务机构应及时为就业困难人员免费提供如下服务：就业政策法规咨询；职业供求信息、市场工资指导价位信息和职业培训信息发布；职业指导和职业介绍；公益性岗位信息发布等。乡镇（街道）、村（社区）公共就业服务机构要建立健全就业困难人员台账管理制度、日常调查走访制度，实时反映变动情况，切实掌握各类就业困难人员的就业情况。 第八条 就业困难人员实现就业创业后，符合政策扶持条件的，可对应享受各类就业创业补贴（详见附件2）。
第九条 市、县（市、区）、肇庆高新区公共就业服务机构应及时将持证的就业困难人员享受的就业扶持政策情况在《就业失业登记证》（或《就业创业证》）上记载，并录入到“广东省人力资源和社会保障业务管理软件系统——就业失业信息管理模块”中的就业困难人员管理数据库，并在申请人《就业失业登记证》（或《就业创业证》）就业援助卡页面上予以标注。 第十条 就业困难人员的认定、审核和管理应严格按照规定程序和要求办理，并接受群众和社会监督。
各级人力资源社会保障（劳动保障）部门要加强对就业困难人员认定工作情况的监督检查。
用人单位或个人提供虚假信息或资料骗取资金，报有关部门严肃查处，情节严重的移交司法机关依法追究有关责任人的责任。经办机构工作人员违反规定认定就业困难人员的，按相关规定严肃追究有关人员责任。 第十一条 本办法自发布之日起施行。此前本市有关就业困难人员的认定管理与本办法不一致的，按本办法执行。
